Is It Fair Use?

Character and Purpose: Parody

Criticism and parody are protected by Fair Use, and parody receives a bit more leeway from courts. However, to be a proper parody, the original work must be used to make a point about that work specifically. This is a difference, for instance, between the Weird Al songs "White and Nerdy", which parodies the attitude of the original "Ridin' [Dirty]", and so would receive more Fair Use Protections; and "The Saga Begins", which is to the tune of "American Pie" but does not comment on it directly, so would receive fewer protections.
